POLITICA DE PRIVACIDAD

De conformidad con lo establecido en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016 relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, y por el que se deroga la Directiva 95/46/CE, así como las demás leyes de carácter nacional que desarrollan el presente reglamento se informa que VIMOTIONS, marca comercial de VIAJES INSULAR, S.A., con C.I.F. A-35004670, domicilio a estos efectos en la calle Pintor Juan Guillermo nº10, Local 1 de Las Palmas de Gran Canaria, código Postal 35011, España actúa como “responsable del tratamiento” o “encargado del tratamiento” de los datos conforme a la legislación vigente.

Para el ejercicio de los derechos que se detallarán más adelante en el presente documento, Viajes Insular S.A. pone a disposición del interesado la dirección de correo: privacidad@vimotions.com

1. DEFINICIONES

DATOS PERSONALES

Datos Personales hace referencia al conjunto de información sobre una persona física identificada o identificable (el interesado); se considera persona física identificable toda persona cuya identidad pueda determinarse, directa o indirectamente, en particular mediante un identificador, como por ejemplo un nombre, número de identificación, dirección, teléfonos o correos de contacto.

RESPONSABLE DEL TRATAMIENTO

Persona física o jurídica que, solo o junto con otros, determine los fines y medios del tratamiento.

ENCARGADO DEL TRATAMIENTO

La persona física o jurídica que trate datos personales por cuenta del responsable del tratamiento.

2. RECOGIDA DE DATOS, FINALIDAD DEL TRATAMIENTO Y PERMANENCIA DE LOS DATOS

Viajes Insular S.A. recopilará los datos personales del interesado, en el mismo momento en que éste solicite la prestación de un servicio a Viajes Insular, directamente del interesado o a través de un “encargado del tratamiento. Los datos personales que Viajes Insular precisa para la prestación del servicio son: Nombre y Apellidos, fecha de nacimiento, N.I.F., domicilio y código postal, teléfono y dirección de correo electrónico. Los datos personales facilitados a esta empresa podrán ser cedidos a personas físicas o jurídicas que se encuentren en territorio internacional, siéndoles aplicables las mismas medidas de protección legal aquí expuestas. Además, existen otra serie de datos que son necesarios para la prestación de cada uno de los servicios solicitados. Entre ellos se encuentran los horarios de los transportes, fechas de la estancia, preferencias y gustos por determinados servicios: ubicaciones en los medios de trasporte, comidas, tipo de alojamientos, etc… Viajes Insular, S.A. utilizará todos estos datos únicamente para prestar el servicio por el propietario de los datos solicitado, así como para poder facturar dichos servicios. Todos estos servicios serán almacenados en los ficheros de Viajes Insular durante el tiempo en que el interesado figure como cliente activo de Viajes Insular y como mínimo por el periodo que legalmente estemos obligados a conservar esos datos de conformidad con la normativa vigente. Para cualquier otro fin que no sea el anteriormente descrito, Viajes Insular solicitará la autorización al titular de los datos previamente, expresa e inequívocamente, indicando el fin de dicha petición. En caso de que el titular de los datos haya autorizado a usarlos con fines distintos, como por ejemplo el envío de publicidad, los datos permanecerán en los ficheros de Viajes Insular mientras el titular no solicite la baja a través del enlace que en cada envío pondremos a disposición del mismo. En el caso de que los datos sean de un menor de edad (menos de 14 años), Viajes Insular entenderá que los datos cedidos son autorizados por sus progenitores o titulares de la patria potestad siempre y cuando estos viajes junto con el menor. En caso de que el menor viaje solo, deberán justificar por los medios oportunos que quienes dan el consentimiento para el tratamiento de los datos son el titular de la patria potestad o tutela sobre el niño. Viajes Insular también podrá recabar los datos por otros medios como pueden ser las diversas páginas webs de las que dispone Viajes Insular. En cualquier caso la finalidad del tratamiento será la expuesta en este apartado.

3. TERCEROS CON ACCESO A SUS DATOS

Viajes Insular S.A. solo cederá los datos del interesado a aquellos terceros que precisen de los datos para poder prestar los servicios por el interesado encargados, y solo para ese servicio contratado. De modo que, aquella información que no sea precisa para la prestación de un servicio concreto no será en ningún caso cedida a ese tercero en concreto. Entre los terceros que requieren de esos datos se encuentran las compañías de transporte, de alojamiento, de coche de alquiler y de servicios complementarios, así como otras empresas que median entre el prestador de servicios (proveedor) y Viajes Insular. En el caso de las empresas que median entre el prestador del servicio y Viajes Insular, éstas solo están autorizadas por Viajes Insular para utilizar los datos solo y exclusivamente para los fines anteriormente descritos, no pudiendo en ningún caso utilizarlos para otro fin distinto. Sin embargo, Viajes Insular no puede garantizar que los datos entregados a los prestadores del servicio (proveedores) no sean utilizados para otro fin del previsto si el titular de los datos (interesado) autoriza posteriormente y directamente a estos para que los utilicen con otros fines. El titular de los datos autoriza con cada encargo o encargos de servicios solicitados a Viajes Insular S.A. a ceder estos datos a terceros para la consecución de dicho fin.

4. CUSTODIA DE LOS DATOS

Viajes Insular ha adoptado todas las medidas y precauciones razonables para que sus datos no puedan llegar ni ser utilizados en ningún caso por personas que no hayan sido autorizadas por el titular de los datos. Estas mismas medidas son exigidas a los terceros que manejan estos datos en nuestro nombre. En caso de que detectáramos una fuga de datos, Viajes Insular actuaría de inmediato conforme a la reglamentación existente informando de inmediato, dentro de las 72 horas siguientes a la Agencia de Protección de Datos, así como al titular de dichos datos en el menor tiempo posible.

5. DERECHOS DEL INTERESADO

El titular de los datos tiene los siguientes derechos:

DERECHO DE INFORMACIÓN Y ACCESO:

El titular tiene derecho a obtener de nosotros información clara, transparente y entendible sobre los datos personales de que disponemos, los fines del tratamiento que hacemos de sus datos, los datos del responsable de los datos: Viajes Insular, S.A, con domicilio en la calle Pintor Juan Guillermo nº 10, Local 1 y código postal 35011 de Las Palmas de Gran Canaria; así como los datos de contacto: privacidad@vimotions.com.

Usted tiene el derecho a disponer de esa información en cuanto nos la solicite, una vez haya acreditado que es el titular de los datos, aunque en caso de solicitudes reiteradas podremos cobrarle una cantidad en concepto de gastos de administración.

DERECHO DE RECTIFICACIÓN:

El interesado tendrá derecho a obtener sin dilación indebida del responsable del tratamiento la rectificación de los datos personales inexactos que le conciernan.

DERECHO AL OLVIDO:

En determinados casos podrá ejercitar su derecho a que los datos personales sean borrados o eliminados. Sin embargo, este derecho no procederá si existieran obligaciones legales en este caso que obligaran a Viajes Insular a conservar los datos por un periodo determinado de tiempo.

DERECHO DE LIMITACIÓN DEL TRATAMIENTO:

El interesado tendrá derecho a obtener del responsable del tratamiento la limitación del tratamiento cuando se cumpla alguna de las condiciones siguientes:

1. Que el interesado impugne la exactitud de los datos personales, durante el plazo que permita al responsable verificar la exactitud de los mismos.

2. Que el tratamiento sea ilícito y el interesado se oponga a la supresión de los datos personales y solicite en su lugar la limitación de su uso.

3. Que el responsable ya no necesite los datos personales para los fines del tratamiento, pero el interesado los necesite para la formulación, el ejercicio o la defensa de reclamaciones. 4. Que el interesado se haya opuesto al tratamiento en virtud del artículo 21, apartado 1, del Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016, mientras se verifica si los motivos legítimos del responsable prevalecen sobre los del interesado.

DERECHO DE PORTABILIDAD:

El interesado tiene el derecho a solicitar que el responsable del tratamiento de los datos personales transfiera en un formato estructurado, de uso común y lectura mecánica, transmita a otro responsable del tratamiento los datos personales que haya recabado del mismo y que le incumban.

DERECHO DE OPOSICIÓN:

El titular de los datos tiene el derecho a oponerse a que sus datos sean tratados en cualquier momento, por motivos relacionados con su situación particular y conforme a lo establecido en el art. 6 del Reglamento. No obstante, el responsable del tratamiento podrá oponerse a este derecho si acredita motivos legítimos imperiosos que prevalezcan sobre los intereses, derechos y las libertades del interesado.

1. DEFINITIONS

PERSONAL DATA

Personal data refers to the collection of information about an identified or identifiable natural person (the data subject); an identifiable natural person is a person whose identity can be verified, directly or indirectly, in particular, by means of an identifier, as an example, a name, identification number, address, telephone number or e-mail address.

DATA CONTROLLER

Natural or legal person who, either alone or jointly or in common with other persons, determines the purposes for which and the manner in which any
personal data are, or are to be processed.

DATA PROCESSOR

Any natural or legal person who processes personal data on behalf of the data controller.

2. DATA COLLECTION, PURPOSE OF DATA PROCESSING AND DATA RETENTION

Viajes Insular S.A. will collect the personal data of the interested party while the latter requests the provision of a service to Viajes Insular, directly from
the interested party or through a «data processor».
The personal data that Viajes Insular needs to provide the service are: Name and Surname, date of birth, Tax ID (or VAT) number, address and postal
code, telephone number and e-mail address.
The personal data provided to this company may be transferred to natural or legal persons who are in international territory, the same legal protection measures set forth herein being applicable to them.
In addition, there is another data that are necessary for the provision of each of the services requested. Among them are transport timetables, dates of
stay, preferences and liking for certain services: location in the means of transport, meals, type of accommodation, etc.
Viajes Insular, S.A. will use all this data only to provide the service requested by the data subject, as well as to bill for these services. All these services
will be stored in the files of Viajes Insular during the time that the interested party appears as an active client of Viajes Insular and at least for the period
that we are legally obliged to keep this data in accordance with current legislation.
For any other purpose other than the one described above, Viajes Insular will request the prior explicit and unequivocal authorisation of the data subject,
indicating the purpose of the request.
In the event that the data subject has authorised the use of them for different purposes, such as sending advertising, the data will remain in the files of
Viajes Insular until the data subject request cancellation through the link that we will make available in each message.
If the data is for a minor (under 14 years of age), Viajes Insular will understand that the data provided are authorised by their parents or guardians as
long as they travel with the minor. In the event that the minor travels alone, they must justify by the appropriate means that those who give consent for
the processing of the data are the holder of parental authority or guardianship over the child.
Viajes Insular may also collect data by other means such as the various websites Viajes Insular have. In any case, the purpose of the processing will
be the one described in this section.

3. THIRD PARTIES WITH ACCESS TO YOUR DATA

Viajes Insular S.A. will only transfer the data of the interested party to those third parties who need the data to be able to provide the services ordered by the interested party and only for that hired service. Therefore, any information that is not necessary for the provision of a specific service will not be
transferred to that specific third party in any case.
Third parties who require this data include transport companies, accommodation companies, car rental and complementary services companies, as well
as other companies that mediate between the service provider (supplier) and Viajes Insular. In the case of the companies that mediate between the
service supplier and Viajes Insular, these are only authorized by Viajes Insular to use the data only and exclusively for the purposes described above,
and under no circumstances may they use them for any other purpose. However, Viajes Insular cannot guarantee that the data provided to the service
providers (suppliers) will not be used for any other purpose than that intended if the data subject (interested party) subsequently and directly authorizes
the latter to use them for other purposes.
The data subject authorizes Viajes Insular S.A. to transfer this data to third parties with each service order or orders requested to Viajes Insular S.A. in
order to achieve this aim.

4. DATA PROTECTION

Viajes Insular has taken all reasonable measures and precautions to ensure that your data cannot be reached or be used under any circumstances by
persons who have not been authorized by the data subject. These same measures are required of third parties who handle this data on our behalf.
In the event that we detect a data leak, Viajes Insular will act immediately in accordance with existing regulations and will immediately inform the Data
Protection Agency within 72 hours, as well as the data subject in the shortest possible time.

5. DATA SUBJECT’S RIGHTS

The data subject has the following rights:

The data subject has the right to access this information as soon as him/her request it from us, once him/her
has provided proof that they are the data subject, although in the event of repeated requests we may charge
him/her a fee for administrative costs.

RIGHT OF RECTIFICATION:

The data subject shall have the right to obtain without undue delay from the data controller the rectification
of inaccurate personal data concerning him/her.

RIGHT TO BE FORGOTTEN:

In certain cases, the data subject may exercise him/her right to have him/her personal data erased or deleted. However, this right will not apply if there are legal obligations in this case that oblige Viajes Insular to retain the data for a certain period of time.

RIGHT TO RESTRICT THE PROCESSING:

The data subject shall have the right to obtain from the data controller the limitation of the data processing when any of the following conditions are met:

1. That the interested party refutes the accuracy of the personal data, during the period of time that allows the data controller to verify the accuracy of them.

2. That the data processing is unlawful and the data subject objects to the deletion of the personal data and instead requests the limitation of their use.

3. That the data controller no longer needs the personal data for the purposes of processing, but the data
subject needs them for the formulation, exercise or defence of claims

4. That the data subject has opposed processing pursuant to Article 21(1) of Regulation (EU) 2016/679 of
the European Parliament and of the Council of 27 April 2016, while it is being verified whether the data
controller’s legitimate reasons prevail over those of the data subject.

RIGHT TO DATA PORTABILITY:

The data subject has the right to request that the data controller transfer the personal data collected from him/her in a structured, commonly used and machine-readable format to another data controller.

RIGHT TO OBJECT:

The data subject has the right to object to the processing of his/her data at any time, for reasons related to his/her particular situation and in accordance with the provisions of Article 6 of the Regulation. However, the controller may object to this right if they can establish compelling legitimate reasons which prevail over
the interests, rights and liberties of the data subject.
